In the rapidly evolving world of artificial intelligence (AI), one of the most pressing concerns is the issue of privacy, especially in the health care sector. Our own personal medical data is undoubtedly going to be more important than our personal financial data in the coming years. AI is revolutionizing medical diagnostics, treatment plans, and patient care, offering unprecedented benefits such as personalized medicine, early disease detection, and automated administrative processes. However, as AI systems handle vast amounts of sensitive patient data, they also introduce significant risks related to privacy breaches, ethical concerns, and regulatory challenges.
The Role of AI in Health Care
AI-driven tools have transformed health care by enabling faster and more accurate diagnoses. Machine learning algorithms can analyze medical images to detect diseases such as diabetic retinopathy and small changes in drusen, which indicate cases of macular degeneration that are imperceivable to the human eye. Predictive analytics can identify at-risk patients, allowing for preventive interventions. Natural language processing (NLP), the form of ambient AI (AI Scribes), facilitates efficient patient data management by summarizing doctor’s notes and extracting relevant information from medical records. These advancements hold immense potential for improving patient outcomes and streamlining health care operations.
However, AI’s reliance on vast datasets, including electronic health records (EHRs), genetic information, and real-time biometric data, presents privacy challenges. The very data that fuels AI’s progress also makes it vulnerable to cyberattacks, unauthorized access, and ethical dilemmas surrounding patient consent and data ownership.
AI Presents These Privacy Challenges
We can break these privacy challenges down into the following four major categories, all which pose risks.
- Data Security and Cyber Threats: One of the biggest concerns in AI-driven health care is data security. Medical records contain highly sensitive information, including patients’ medical histories, genetic profiles, personal identifiers such as social security information, and financial information such as credit card numbers. Hackers view this data as valuable for identity theft, insurance fraud, and other malicious activities. The integration of AI into health care systems has increased the “attack surface” for cybercriminals. Candidly, health care facilities, with little or no IT cybersecurity supervision pose an easier target than a large financial institution with an entire corps of cybersecurity specialists. Ransomware attacks on hospitals and health networks have surged in recent years, with hackers encrypting patient data and demanding hefty ransoms. AI models themselves can even be susceptible to adversarial attacks, where malicious actors manipulate input data to deceive AI systems into making incorrect predictions or diagnoses.
- Informed Consent and Data Ownership: AI’s reliance on large datasets raises ethical concerns regarding informed consent. Many AI algorithms require access to vast amounts of patient data to train and improve their performance. However, patients are often unaware of how their data is being used or shared. A key issue is data ownership. Should patient data belong to individuals, health care providers, or tech companies developing AI solutions? Some argue that patients should have full control over their health data and be allowed to opt in or out of AI-driven research. Others contend that broader data sharing is necessary for scientific advancement. Striking a balance between innovation and individual rights remains a challenge. Another concern is the potential for AI to be used to make decisions about people’s health without their consent. For example, AI could be used to decide who gets access to certain treatments or medications. This could lead to inequities in health care, with some people being denied access to care based on their race, gender, or socioeconomic status.
- Bias and Discrimination: AI systems in health care can inadvertently reinforce biases present in their training data. If an AI model is trained on data that lacks diversity or reflects historical inequities, it may produce biased results. Bias in AI-driven health care decisions can lead to disparities in diagnosis and treatment. A lack of transparency in AI decision-making, often referred to as the “black box” problem, exacerbates these concerns, making it difficult to identify and rectify biased outcomes.
- Regulatory and Compliance Challenges: Governments and regulatory bodies are grappling with how to ensure AI in health care operates ethically and securely. Existing regulations, such as HIPAA and the GDPR in Europe, aim to protect patient data privacy. However, these laws were not originally designed with AI in mind, and new frameworks need to be developed to address the unique challenges posed by AI-driven health care solutions. For instance, HIPAA primarily governs health care providers and insurers, but what about AI developers and tech companies that process health data? Policymakers must work to bridge these regulatory gaps while fostering innovation and getting everyone to agree on risks that are largely unknown and unregulated.
Strategies to Protect Patient Privacy
While the challenges are significant, here are various strategies that can help protect patient privacy in AI-powered health care.
- Keep the data localized to make it harder for bad actors to intercept or steal it. Often called “privacy-preserving AI,” these methods may be able to enhance data security. Examples of this include decentralizing the data back to local servers. The challenges with this method are that once again it is easier for bad actors to enter through a local unprotected portal than to hack into a large centralized and well protected site, so I am not sure this is the ideal option. Another approach is to add “noise” to the datasets to make tracking of the process more difficult. A slightly different version may be to split the data into pieces and save them with different code sets or algorithms on different servers so the hacker would have to hack multiple sites synchronously to correlate the data. For example, the demographics would be in one format on one server, the financial information would be in a different code set on a different server, and the clinical notes might be elsewhere yet. Yet another option called homomorphic encryption would be to use advanced encryption that would allow AI to process data without needing to decrypt it, thus preserving confidentiality.
- Identity Challenges. Both health care organizations and AI product developers will also need to be keenly aware of potential challenges around identity. For example, Dr. X uses a scribe or even a virtual avatar that is published on social media. Meanwhile bad actors develop a “look-alike” scribe pretending to be Dr. X or someone from Dr. X’s office to gain a patient’s trust. The patient then gives information to the bad scribe who uses it for nefarious purposes. Ensuring identities of consumers and providers will be essential. This can be largely remedied through multifactorial verification methods. Identification can also be assured by having the AI sitting inside a portal that the patient accesses without prompting. This is similar to how financial institutions have users log in to the financial platform rather than opening an e-mail from a financial services organization.
- Stronger Data Governance Policies. Health care organizations must implement robust data governance policies to ensure AI-driven systems comply with privacy regulations. This might include clear data-sharing agreements that specify how patient data is used and who has access to it as well as regular audits to monitor AI decision-making processes for biases and inaccuracies. It might also include some mandate that results in implementation of anonymization and pseudonymization techniques to protect patient identities.
- Patient Empowerment and Transparency. It is the patient’s data, so patients should be informed about how their data is being used and given the ability to control its usage. Health care providers and AI developers can enhance transparency by providing clear, accessible privacy policies that outline data usage in plain language and in the user’s native language to allow patients to opt in or out of AI-driven research and data-sharing initiatives.
- Stronger Regulatory Frameworks. Though this may take a few years because of the challenges of governments and industry stakeholders actually agreeing on terms, these organizations must collaborate to develop AI-specific regulations that address emerging privacy concerns and establish clear guidelines on AI data usage, storage, and sharing. Accountability structures for AI-related privacy breaches must also be defined.
The Future of AI and Privacy in Health Care
The battle for privacy in AI-driven health care is not about resisting technological progress but ensuring that innovation does not come at the cost of patient rights. I believe that AI has the potential to revolutionize the medical field. However, with the right combination of privacy-preserving technologies, robust regulations, and ethical AI development practices, the health care industry can harness AI’s full potential while safeguarding patient privacy. Ultimately, the success of AI in health care will hinge on public trust. If patients and health care professionals believe that AI systems are secure, transparent, and fair, they will be more likely to embrace these technologies. By addressing privacy challenges head-on, the health care industry can pave the way for an AI-powered future that is both innovative and ethically responsible.
The use of AI in medicine is still in its early stages. As AI technology continues to develop, it is important to continue to monitor the potential impact of AI on privacy. We need to be prepared to adapt our privacy protections as AI technology evolves. It is also important to remember that AI is not a sentient being. AI is a tool that can be used for good or for evil. It is up to us to make sure that AI is used in a way that benefits humanity.
